Terms & Conditions
Last updated: October 16, 2026
These Terms and Conditions (the “Terms”) govern your use of the Dila Design website (the “Website”) and the home staging, interior design, and related services provided by Dila Design LLC (“Dila Design,” “we,” “us,” or “our”) (the “Services”). By using the Website, booking a consultation, accepting a proposal, or receiving our Services, you agree to these Terms. If you do not agree, please do not use the Website or our Services.
Please read Sections 20 and 21 carefully. They limit our warranties and our liability.
WEBSITE AND GENERAL TERMS
1. Your Service Agreement and These Terms
Each staging or design project is governed by a written proposal, quote, or service agreement that you accept, sign, or pay (your “Service Agreement”). Your Service Agreement sets out the scope, pricing, rental period, payment schedule, and other details for that project. These Terms apply to every project and supplement your Service Agreement. If these Terms and your Service Agreement conflict, your Service Agreement controls for that project.
2. Eligibility and Authority
You must be at least 18 years old and able to enter into a binding contract to use our Services. If you request Services on behalf of a property owner, company, or brokerage, you confirm that you are authorized to do so and that the owner has approved the work and our access to the property. The person or company named as the client in the Service Agreement is responsible for its obligations, including payment.
3. Use of the Website
You may use the Website to learn about and request our Services. You agree not to:
- copy, reproduce, scrape, or redistribute Website content, photographs, or designs without our written permission;
- use the Website in any way that violates the law or infringes anyone’s rights;
- submit false or misleading information, or information about another person without their permission;
- attempt to gain unauthorized access to the Website or its systems, or interfere with its operation, including by introducing viruses or malicious code; or
- use automated tools to collect information from the Website.
4. Intellectual Property and Listing Photos
All content on the Website, including text, photographs, videos, design concepts, logos, and the Dila Design name and branding, is owned by Dila Design or its licensors and is protected by copyright, trademark, and other laws. Our staging designs and layouts, and the photographs and videos we create of our work, remain our property.
Listing photos. Property owners and their real estate agents may use photographs and videos of a property taken while it is staged by Dila Design to market that property for sale or rent, including in MLS listings, listing websites, brochures, and social media, and agents may include those images in their portfolio of past listings. Any other use, such as advertising a different property or selling the images, requires our written permission.
5. Website Information and No Guarantee of Results
We work to keep the Website accurate, but descriptions, photographs, statistics, and other information are provided for general information and may change without notice. Photographs show past projects, and the furniture and décor used in your project will vary based on availability and the property. Statistics and client testimonials reflect past experiences and are not a promise of future results.
Staging and design are intended to present a property at its best, but we do not guarantee that a property will sell or rent, sell within a certain time, or achieve a certain price or number of offers. Market conditions, pricing, location, property condition, and many other factors outside our control affect those results.
STAGING AND DESIGN SERVICES
6. Consultations, Quotes, and Booking
Contacting us or booking a consultation through the Website or our online scheduling tool does not create a contract for staging or design Services. Quotes and proposals are based on the information available to us and are valid for the period stated on them. A project is confirmed only when you accept the Service Agreement and make any required deposit or initial payment. Installation dates depend on availability. We recommend booking two to three weeks in advance and will try to accommodate shorter timelines when we can. Prices do not include applicable taxes unless stated.
7. Staging Furniture and Décor
- Ownership. All furniture, art, décor, rugs, linens, and accessories we provide for staging (“Staging Items”) remain the sole property of Dila Design. Staging is a rental. You do not acquire any ownership interest in Staging Items, and you may not sell, lend, move off the property, or dispose of them.
- Display only. Unless your Service Agreement states otherwise, Staging Items are for display and decoration only and are not intended for everyday use. Please do not sleep in staged beds, use staged linens, towels, or kitchenware, or place weight on decorative pieces.
- Care of the property. While Staging Items are in the property, please keep it clean and secure, keep utilities (including heating, cooling, and electricity) on, and promptly address leaks, pests, or other conditions that could damage Staging Items. Please contact us before rearranging or removing any Staging Items.
- Loss and damage. While Staging Items are in the property, you are responsible for loss, theft, or damage beyond normal wear and tear, including damage caused by occupants, visitors, buyers, agents, contractors, pets, smoke, or water, except damage caused by our team. We will invoice you for the reasonable cost to repair, clean, or replace affected items. We recommend confirming that your property insurance covers personal property of others in your care.
- Pets and smoking. Please tell us before installation if pets will be present or if anyone smokes in the property. We may require a refundable pet deposit as stated in your Service Agreement. Damage from pet hair, odors, stains, or smoke is your responsibility.
- Safety. Staging Items are not childproof. Lamps, mirrors, art, and decorative accessories may be fragile or may tip if misused. You are responsible for supervising children, visitors, and pets in the property.
8. Rental Period, Renewals, and De-Staging
Unless your Service Agreement states otherwise, staging includes an initial rental period of 30 days starting on the installation date. If Staging Items remain in the property after the initial period, the rental continues month to month at the renewal rate stated in your Service Agreement until the items are removed.
To schedule de-staging, contact us in writing as early as possible so we can schedule our crew. Rental charges continue until the Staging Items are removed, unless a delay in removal is caused by us. If the property is sold or possession changes hands, you remain responsible for the Staging Items until we remove them, so please schedule de-staging before closing or move-in.
9. Access to the Property
You authorize Dila Design and our team, crews, and movers to enter the property to install, inspect, maintain, adjust, and remove Staging Items during the rental period, at reasonable times and with notice when practical. On scheduled dates, you agree to provide safe access, including working utilities, clear pathways, and current keys or access codes. If our crew cannot access the property or cannot safely perform the work, a trip or rescheduling fee may apply.
Our team works carefully when moving items into and out of the property. If you believe our team caused damage to the property, please notify us promptly after the installation or removal, with photos, so we can review and resolve it.
10. Occupied Homes and Your Belongings
For occupied home staging and consultations, we may recommend or carry out rearranging, editing, or temporarily relocating your furniture and belongings. You are responsible for removing, packing, and storing items you do not want displayed, and for securing valuables, jewelry, cash, medications, firearms, and important documents before we arrive. We handle your belongings with care, but we are not responsible for pre-existing damage, for fragile or unstable items you did not point out to us, or for items we did not handle. Storage of items removed from the home is your responsibility unless we agree otherwise in writing.
11. Procurement and Purchased Items
For short-term rental setups and design projects where we purchase furniture, décor, and supplies on your behalf:
- You approve purchases before we order them, and you are responsible for the full cost of approved items, plus applicable taxes and shipping. Items purchased for you are your property.
- Procurement, design, delivery, installation, and styling fees are billed as stated in your Service Agreement.
- Once an order is placed, cancellations, returns, and exchanges are subject to each vendor’s policies, including any restocking fees and return shipping costs, which you are responsible for.
- Manufacturers and vendors are responsible for product warranties, defects, and shipping damage. We will help coordinate claims with vendors as part of our procurement service, but we do not provide our own warranty on purchased products.
- Availability, pricing, lead times, colors, and finishes are set by vendors and may change. We are not responsible for vendor delays or discontinued items, and we will work with you to find suitable substitutes.
12. Design Services and Color Consultations
Design recommendations, color selections, layouts, and product suggestions are based on our professional judgment and the conditions we observe at the time. Colors can look different depending on lighting, surfaces, finishes, and the manufacturer, so we recommend testing samples in your space before committing. You are responsible for the decisions you make based on our recommendations and for hiring and supervising any painters, contractors, or other trades, unless we agree in writing to manage them. We do not provide architectural, engineering, electrical, plumbing, structural, or building code services or advice.
13. Event Staging
Event staging is provided under the Service Agreement for that event, which sets out the set-up and removal times and venue requirements. Unless we agree otherwise in writing, the client is responsible for loss of or damage to Staging Items caused by event attendees, venue staff, or other vendors.
14. Payment, Late Fees, and Collections
- Payment amounts, deposits, due dates, and accepted payment methods are stated in your Service Agreement and invoices.
- Payment is not contingent on the sale, closing, or rental of the property, or on any arrangement between the property owner and the agent.
- Late payments are subject to the late fees stated in your Service Agreement or invoice, to the extent permitted by law.
- If an account remains unpaid, we may pause or decline further Services, schedule removal of Staging Items, and refer the account to an attorney or collection agency. You agree to pay our reasonable costs of collection, including attorney’s fees and court costs, to the extent permitted by law.
- Please raise any question about an invoice in writing promptly, and pay any undisputed amount by the due date.
15. Cancellations and Rescheduling
Cancellation and rescheduling terms, including any non-refundable deposit, are stated in your Service Agreement. If your Service Agreement does not address a cancellation or postponement, you are responsible for reasonable costs we have already incurred for your project, such as design work, items purchased or ordered on your behalf, and crew time reserved for your project.
16. Photography and Marketing
You grant Dila Design permission to photograph and record video of the property and our work, before, during, and after the project, and to use those images and videos in our portfolio, on the Website and social media, in proposals, and in other marketing, without payment to you. This permission continues after the project ends. We will not include your name, or personal belongings that identify you, without your permission, and we may describe the property by its city or neighborhood. If you would like an image removed from our Website or social media, contact us and we will make reasonable efforts to remove it.
17. Reviews and Testimonials
If you send us a testimonial or review, you allow us to use it, together with your name, in our marketing. You may contact us at any time to withdraw that permission for future use.
LEGAL TERMS
18. Text Messages and Electronic Communications
By giving us your phone number and email address, you agree that we may contact you about your inquiry and project by phone, email, and text message. Marketing text messages are sent only with your consent, and consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help, or contact us at contact@diladesign.com or 804-840-1563. Carriers are not liable for delayed or undelivered messages. Our Privacy Policy explains how we handle your mobile information.
You also agree that proposals, Service Agreements, invoices, and notices may be delivered and signed electronically, and that electronic signatures have the same effect as handwritten signatures.
19. Third-Party Services and Links
The Website may link to or use third-party services, such as our online scheduling tool, payment processors, maps, and social media platforms. Your use of those services is subject to their own terms and privacy policies, and we are not responsible for their content, availability, or practices.
20. Disclaimer of Warranties
We will perform the Services in a professional and workmanlike manner.
EXCEPT FOR THAT COMMITMENT AND ANYTHING EXPRESSLY STATED IN YOUR SERVICE AGREEMENT, THE WEBSITE AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, DILA DESIGN DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DILA DESIGN AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SALES, DELAYED CLOSINGS, OR DECREASES IN PROPERTY VALUE, ARISING OUT OF OR RELATED TO THE WEBSITE OR THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE WEBSITE OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO DILA DESIGN FOR THE SERVICES GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY TO PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, TO OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR WHERE THE LAW DOES NOT ALLOW THEM.
22. Indemnification
You agree to defend, indemnify, and hold harmless Dila Design and its owners, employees, and contractors from claims, losses, damages, and expenses, including reasonable attorney’s fees, arising from (a) your misuse of the Website, (b) your breach of these Terms or your Service Agreement, (c) conditions at the property that you knew or should have known about, or (d) the acts of occupants, visitors, buyers, agents, contractors, or pets at the property, except to the extent caused by our negligence or misconduct.
23. Governing Law and Disputes
These Terms and your Service Agreement are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law rules. If a dispute arises, please contact us first so we can try to resolve it informally. If we cannot resolve it within 30 days, either party may bring a claim in the state courts located in Hanover County, Virginia, or in the United States District Court for the Eastern District of Virginia, Richmond Division, and both parties consent to the jurisdiction and venue of those courts. The informal resolution period does not apply to the collection of unpaid amounts. Either party may also bring an eligible claim in small claims court.
24. Changes to These Terms
We may update these Terms from time to time by posting the updated version on the Website and changing the “Last updated” date. The Terms in effect when you accept your Service Agreement apply to that project unless both parties agree otherwise. Your continued use of the Website after an update means you accept the updated Terms.
25. General Terms
- Entire agreement. These Terms, your Service Agreement, and our Privacy Policy are the entire agreement between you and Dila Design about their subject matter.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permitted, and the rest of these Terms will remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign your rights or obligations without our written consent. We may assign ours in connection with a sale or reorganization of our business.
- Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, natural disasters, illness, vehicle breakdowns, vendor or supply delays, or government actions. We will reschedule as soon as reasonably possible.
- Survival. Sections 4, 7, 8, 14, 16, 20, 21, 22, and 23 survive the end of a project or your use of the Website.
- Headings. Section headings are for convenience only and do not affect the meaning of these Terms.
